Wrongful death claims in Minnesota are brought by a trustee.  A trustee is usually a family member, appointed by the court, to represent the close relatives of the deceased. The trustee brings the wrongful death claim on behalf of the decedent’s heirs, namely the spouse and blood relatives.  In Minnesota, a wrongful death lawsuit must be started within three years of the death or it will be barred by the statute of limitations.
